Terms ofService

By accessing or using the mynd platform, APIs, SDKs, or related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

You must create an account to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You agree not to use the Services to:

• ↳Violate any applicable law or regulation
• ↳Transmit any material that is defamatory, obscene, or otherwise objectionable
• ↳Interfere with or disrupt the integrity or performance of the Services
• ↳Attempt to gain unauthorized access to any portion of the Services
• ↳Use the Services to build competitive products or services
• ↳Reverse engineer, decompile, or disassemble any part of the Services

The Services and all associated intellectual property rights are owned by Mynd Labs, Inc. Your agent configurations, prompts, and outputs remain your property. You grant us a limited license to process your data solely to provide the Services.

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated herein or required by applicable law. We reserve the right to change our pricing with 30 days' advance notice. Overage charges apply as described in our pricing documentation.

Enterprise customers are entitled to the service level commitments described in our Service Level Agreement at myndlabs.tech/legal/sla. Free and Pro plans are provided on a best-effort basis without uptime guarantees.

Either party may terminate this agreement at any time. Upon termination, we will delete your data in accordance with our retention policy. Sections relating to intellectual property, liability, and governing law survive termination.

To the maximum extent permitted by law, Mynd Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability shall not exceed the amount paid by you in the twelve months preceding the claim.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
